GENERAL TERMS AND CONDITIONS FOR USING THE WEBSITE
The usage of this website, including the placement of orders shall constitute agreement and acceptance of these terms and conditions. If you DO NOT AGREE with those, please cease using the website. Solingen – Tzvetko Georgiev & Son EOOD expressly retains its rights, including amending the terms and conditions, at any time and without prior warning. All new terms and conditions will be published on the website.
I. General terms and conditions:
• “www.2styrkela.com” (with English version “www.2storksbgshop.com”) is a website for presentation of the large number of goods of the company and for conducting online trading by selling and delivering the goods listed on the website on behalf of firm Solingen – Tzvetko Georgiev & Son EOOD.
• The publishing of these websites shall constitute a public invitation for the conclusion of a trade of purchasing goods online from Solingen – Tzvetko Georgiev & Son EOOD.
• Solingen – Tzvetko Georgiev & Son EOOD via “www.2styrkela.com” (with English version “www.2storksbgshop.com”) retains the right to change all prices of goods on its own accord and without prior notification. The user shall be obliged to pay the price which was listed at the time of placement of an order and the confirmation of the same for the goods chosen. Discounted prices shall be shown by placing the new price below the old price, the latter being crossed through.
• Should the good(s) ordered not be in stock, Solingen – Tzvetko Georgiev & Son EOOD, within one working day of receipt of the order on “www.2styrkela.com” (with English version “www.2storksbgshop.com”), will inform the client of the lack of stock via sending an email to the address provided by the client or on the phone number listed by the client.
• If the address listed is incomplete or wrong and/or the contact person and/or telephone and email details are incomplete or wrong, Solingen – Tzvetko Georgiev & Son EOOD via “www.2styrkela.com” (with English version “www.2storksbgshop.com”) shall be relieved of all responsibility for the delivery of the order.
• The contract with the client shall be considered signed and agreed by both parties upon receipt by Solingen – Tzvetko Georgiev & Son EOOD via “www.2styrkela.com” (with English version “www.2storksbgshop.com”) of the correctly complete order list or request and confirmed by the client on the provided by him/her email or phone number.
• Solingen – Tzvetko Georgiev & Son EOOD via “www.2styrkela.com” (with English version “www.2storksbgshop.com”) shall deliver the order placed by the client upon receipt and confirmation of order by the client.
• Solingen – Tzvetko Georgiev & Son EOOD via “www.2styrkela.com” (with English version “www.2storksbgshop.com”) shall not bear any responsibility should the client provide incorrect and/or incomplete details on orders placed on the website.
• Solingen – Tzvetko Georgiev & Son EOOD does not guarantee total match of the goods listed on the website and the goods available for purchase in the network of own shops or resellers.
• Solingen – Tzvetko Georgiev & Son EOOD shall not bear responsibility for mistakes in the published information on the website. Changes in prices in the shops are possible as well as the design of products.
• The published information on the website regarding colour(s), size(s) and other characteristics shall not be considered definitive but only informative. Solingen – Tzvetko Georgiev & Son EOOD does not bear responsibility for any differences in sizes listed and actual sizes.
• The categorization of goods based on their usage (filter hairdressing) is for examples only.
• All prices on the site “www.2styrkela.com” are listed in Bulgarian leva (BGN) with the VAT included. All prices on the English version on the site “www.2storksbgshop.com” are listed in Euro (EUR) with the VAT included.
II. Rights and responsibilities of the parties
1. Solingen – Tzvetko Georgiev & Son EOOD shall:
• confirm the stock availability of the ordered goods or cancel the order within 3 working days. • deliver, in the timeframe listed under delivery and payment information, the ordered goods.
• verify, before sending, every good for technical fitness of same (if possible, without damaging the packing of the goods).
• guarantee that all goods are new and unused before and sealed by the producer, unless contrary information is provided for the specific good listed on the website.
2. The client shall:
• list his/her full name, correct and valid phone number, including all country and area codes, address for delivery and email address.
• pay the price of the good(s) based on the conditions listed in the information for delivery and payment of orders.
• pay the price of delivery based on the conditions listed in the information for delivery and payment of orders.
• provide access and availability for receipt of the order.
The order of goods shall be delivered to the address for delivery given by the client within the timeframe listed in the information for delivery and payment of orders.
The goods shall be delivered with the packaging necessary based on the type of goods and/or transport.
Upon receipt of the order, the Client or a third person shall sign the accompanying documents. A third person shall be considered to be anyone, who is not the client as listed on the order, but will accept the order at the address given.
Should the delivery be refused, besides in cases listed below, the refusal shall be considered unfounded and the client shall be obliged to pay for the delivery and returning of the order. In such a case, the client shall compensate Solingen – Tzvetko Georgiev & Son EOOD for all consequential costs, including but not limited to damages, lost revenue, and other costs besides the costs for delivery and return, resulting from the refusal.
In case the client cannot be found within the timeframe for delivery of the order at the given by the client address or access and/or conditions for receipt of the order are not met in the timeframe listed for delivery, Solingen – Tzvetko Georgiev & Son EOOD shall be relieved of all responsibility for delivery of the order of goods.
The client can reconfirm his/her willingness to receive the goods after the expiry of the delivery period, during which he/she could not be found at the address, but this will entail his/her acceptance for payment of all associated costs for the re-delivery. In such a case, a new timeframe for delivery will commence once the re-delivery is confirmed.
The client shall have the right to refuse acceptance of the delivery of the order placed by him/herself should the goods be delivered in one of the following cases:
• the delivered goods are obviously not matching the ordered by the client goods, which could be easily established by looking at the goods.
• the price that the client has been asked to pay does not correspond to the price due
• in case of a mismatch between ordered goods and delivered goods, which could not be established at the moment of delivery.
The client shall have the right to request a change in the size or a good(s), which was part of his/her original order.
In such a case, the client shall communicate his/her wish either in writing (email) or orally (phone) no later than 7 days using the coordinates provided on the website.
The client shall be entitled to the right to cancel the contract, without any payments for compensation or interest and without any express reason(s), and to return the goods basis following conditions:
• the request for cancellation is submitted in writing on the given by Solingen – Tzvetko Georgiev & Son EOOD email address no later than 14 days, with the date of receipt of the goods to count as day 1 (the standardized form for cancellation of a contract can be found here). The request for cancellation must include a personal bank account of the client, with all relevant banking details including IBAN and BIC, which will be used to credit the amount due for the order.
• the goods have not lost their original appearance and merchantability, are packed in the original packaging, with the original stickers and accompanied by the original documents issued by Solingen – Tzvetko Georgiev & Son EOOD – receipt, warranty (if such has been issued) and others
• the client agrees with a representative of Solingen – Tzvetko Georgiev & Son EOOD the address on which Solingen – Tzvetko Georgiev & Son EOOD should receive the returned goods.
• the client shall pay all costs associated with the delivery of the goods to the address given by the representative of Solingen – Tzvetko Georgiev & Son EOOD
Solingen – Tzvetko Georgiev & Son EOOD retains the right to not return the paid by the client sum should one or more of the conditions for return of goods not be met.
III. Personal data:
• Solingen – Tzvetko Georgiev & Son EOOD via “www.2styrkela.com” (with English version “www.2storksbgshop.com”) will take all due care for the protection of the personal data of the client, which have been submitted when filling out the electronic form for placement of orders. This responsibility shall not be guaranteed should the client provide false data.
• In compliance with current legal provisions and the clauses of these Terms and conditions, Solingen – Tzvetko Georgiev & Son EOOD can only use the personal data of clients only for the aims, described in the contract.
• Solingen – Tzvetko Georgiev & Son EOOD via “www.2styrkela.com” (with English version “www.2storksbgshop.com”) retains the right to use the information for offering goods and/or services to the Client, for promotions, sending of greetings, organization of draws, questionnaires, and for statistical and all other purposes permissible by law unless express disagreement has been given by the client to the following email address: office@2styrkela.com.
• the above described goals for which personal data may be used is not conclusive or complete and shall not give rise to any responsibilities for Solingen – Tzvetko Georgiev & Son EOOD via “www.2styrkela.com” (with English version “www.2storksbgshop.com”). All other goals for which personal data may be used will respect the applicable Bulgarian legislation, international acts, internet etiquette and the rules of moral and good behavior.
IV. Disclosure of personal data:
• Solingen – Tzvetko Georgiev & Son EOOD via “www.2styrkela.com” (with English version “www.2storksbgshop.com”) shall not disclose personal data of the client to third parties – public authorities, trade organizations, natural persons and other except in cases when:
• an express written agreement by the client has been received
• the information is requested by public authorities or persons authorized to act on their behalf, who, according to the current applicable legislation, are entitled to demand and collect the information requested.

V. Responsibility

VI. Arbitrage
All cases of disagreement between the sides are to be resolved in the spirit of collaboration and good will. In case where agreement cannot be reached, all disagreements coming from the contract between the parties or related to it, including disagreements for or regarding the meaning of the contract, its invalidity, the conduct of parties or the cancellation of same, as well as disagreements regarding the absence of clauses in the contract or its adaptation to newly emerged circumstances, will be resolved by the competent courts in regards to the registration of Solingen – Tzvetko Georgiev & Son EOOD and Bulgarian law.
VII. Warranty conditions:
1. The firm Solingen – Tzvetko Georgiev & Son EOOD gives its clients who have bought goods with warranty, a warranty card, which contains:
• the address and telephone of the authorized service
• the warranty conditions of the respective service centers and/or producers
• warranty period for the good(s) bought.
2.Except for the responsibilities specifically mentioned in the warranty, firm Solingen – Tzvetko Georgiev & Son EOOD cannot be responsible for direct, indirect, special, random or consequential damages, irrespective of whether those are based on a contract, damage resulting from a mistake of an officer or another legal theory and whether such possibility for damage has been taken into consideration.
3. For all products the applicable warranty conditions of the respective producer or authorized service center shall be valid. In the service centers only the original warranty cards with which the good(s) were delivered shall be valid.
VIII. Limitations of warranty
The warranty shall cease to apply in cases of:
1. Damages resulting from bad freight, storage or incorrect exploitation.
2. Attempted servicing by the client and/or other unauthorized persons.
3. Usage of low quality or non-original supplies
IX. Additional terms:
1. Solingen – Tzvetko Georgiev & Son EOOD shall bear no responsibility for damages caused by force major circumstances.
